These Terms and Conditions govern your use of the Surfdancer Academy of Surf website (surfdancer.com) and any products or services offered through it. By accessing this website or purchasing any product or service, you agree to be bound by these terms.

1. About Us

Surfdancer Academy of Surf is operated by Surfdancer Pty Ltd (ABN 66 437 456 125), Noosaville QLD 4566, Australia. References to "Surfdancer," "we," "us," or "our" in these Terms and Conditions refer to Surfdancer Pty Ltd.

2. Use of This Website

This website is provided for informational purposes and to facilitate access to Surfdancer's digital products and services. By using this website, you agree to:

Use it only for lawful purposes

Not reproduce, distribute, or create derivative works from any content without prior written permission

Not attempt to gain unauthorised access to any part of this website or its systems

Not use the website in any way that could damage, disable, or impair its operation or the reputation of the Surfdancer brand

3. In-Person Services

Surfdancer Academy of Surf is no longer accepting bookings for in-person surf lessons, school programs, or surf instructor training. Content relating to these services remains on this website for informational and archival purposes only.

4. Digital Products and Online Courses

Access: Upon completing a purchase, you will receive access to the digital content as described at the time of purchase. Access is for your personal, non-commercial use only.

Refunds: Due to the nature of digital products, refunds are generally not available once content has been accessed or downloaded. This does not affect any rights you may have under the Australian Consumer Law.

Availability: We make every reasonable effort to ensure continuous access to digital products. However, we do not guarantee uninterrupted availability and accept no liability for temporary outages or technical issues beyond our control.

Sharing: Your access to digital products is personal and non-transferable. You may not share login credentials, resell, or redistribute any digital content.

5. Intellectual Property

All content on this website — including text, images, video, course materials, graphics, and design — is the property of Surfdancer Pty Ltd and is protected under Australian and international copyright law.

Surfdancer® is a registered trademark of Surfdancer Pty Ltd (Australian Registration No. 1730589; International Registration No. 1 918 545). Surfdancing™ is a trademark of Surfdancer Pty Ltd (application pending). Unauthorised use of these marks is prohibited.

Nothing on this website grants any licence or right to use Surfdancer's intellectual property without our express written consent.

To the maximum extent permitted by law, Surfdancer Pty Ltd is not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, this website or any products or services purchased through it.

Nothing in these Terms and Conditions excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law that cannot be excluded.

Your use of this website is also governed by our Privacy Policy, which is available on this website and is incorporated into these Terms and Conditions by reference.

11. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes.

We may update these Terms and Conditions at any time. Changes will be posted on this page with a revised "Last updated" date. Your continued use of this website after any changes constitutes your acceptance of the updated terms.

Lessons and Activities

 

Clients will obtain a refund or credit if:

 

  • the client notifies the ASI Accredited school 24 hours prior to the time of the activity.  

  • the Instructor cancels the activity due to unsuitable or dangerous conditions.  

Note - no refund will be offered if it rains.   

 

If water and weather conditions become unsafe during the activity, the instructor may modify the activity and undertake activities on the shore rather than in the water, or the activity may be rescheduled for another time. 

 

If the client has paid for a block of lessons at a discounted price, the refund will be based on the total amount paid less the lessons already delivered calculated at the undiscounted lesson price.

 

No refund is offered if the client refuses to comply with the ASI Accredited School policy and the Instructor determines the client cannot participate in the activity (e.g. client is under the influence of drugs or alcohol)

 

If the client advises the Instructor of a medical condition such that the Instructor decides that it would be unsafe for the client to participate in the activity, a full refund will be offered. 

 

If the Instructor becomes aware of a client’s medical condition after the lesson has commenced, such that the Instructor determines it is unsafe for the client to continue in the activity, no refund will be offered.

 

Gift Vouchers

 

Gift vouchers must be used by expiry date unless other arrangements have been made. No refund is offered once the gift voucher has been purchased however the gift vouchers are transferable to other people.

 

Hire

 

The client will obtain a refund is they notify the ASI Accredited School 24 hours prior to the time of the hire.  No refund will be made once the client has paid for and taken delivery of the hire equipment.

 

Product Purchase

 

Up to 30 days from date of purchase the client can:

  • obtain a 100% refund for products purchased should they be damaged or faulty.

  • exchange for products that are unsuitable.

 

Activity Tours

 

Clients can obtain a refund or credit if:

  1. the client notifies the ASI Accredited School 5 days prior to the time of the tour. An administration fee of 20% may be charged.

  2. the ASI Accredited School cancels the tour.​
